Your Statutory Rights
This policy is provided in accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484 of 2013) and the Consumer Rights Act 2022. If you are a consumer (acting outside your trade, business, craft or profession), your statutory rights apply. These rights cannot be waived by any contract or policy.
14-Day Right to Cancel (Distance Contracts)
When you book a consultation at a distance (e.g. online, by phone, or by email) — a "distance contract" — you generally have a 14-day right to cancel without giving any reason. The cancellation period runs from the day the contract is concluded.
- To cancel, inform us of your decision by an unambiguous statement (e.g. email or post) before the 14-day period expires. You may use the model cancellation form available from us on request.
- If you cancel within the 14-day period, we will reimburse all payments received from you without undue delay and in any event within 14 days of the day we are informed of your decision. We will use the same payment method you used, unless you agree otherwise (you will not incur fees as a result).
- If you ask us to start the service during the 14-day period: You must make an express request (e.g. in writing). If you then cancel before the service is fully performed, you must pay us an amount in proportion to what has been provided up to the time you notified us of cancellation, compared to the full contract.
- Exception: The 14-day right does not apply where the service has been fully performed, and performance began with your prior express consent and your acknowledgement that you would lose the right to cancel once the contract was fully performed. We will only rely on this where we have clearly informed you and you have agreed.

Consultation Services
Our garden consultations are professional advisory services. The following appointment cancellation terms apply when the statutory 14-day cancellation right does not apply (e.g. you have waived it by requesting an early visit, or the 14 days have passed, or the contract was not made at a distance):
Cancellation Before Consultation
- Cancellations made more than 48 hours before the scheduled appointment: Full refund
- Cancellations made 24–48 hours before the scheduled appointment: 50% refund
- Cancellations made less than 24 hours before the scheduled appointment: No refund
Rescheduling
You may reschedule your consultation free of charge if you give at least 24 hours’ notice. Rescheduling with less than 24 hours’ notice may be subject to availability and a rescheduling fee.
Weather-Related Postponements
Garden consultations may need to be postponed due to severe weather conditions. In such cases, we will offer alternative dates at no extra cost. If no suitable alternative can be arranged, a full refund will be provided.
Service Satisfaction
Your satisfaction is important to us. If you are not satisfied with your consultation, please contact us within 7 days of the service date. We will work with you to address your concerns and may offer:
- A follow-up consultation at no additional charge
- Additional written guidance on areas of concern
- Partial credit towards future services
Annual Care Plans
For Annual Care Plan subscriptions (distance contracts):
- You have the 14-day statutory right to cancel as described above. If no services have been performed, you receive a full refund.
- If you have requested performance during the 14-day period and then cancel, you pay proportionally for what was provided.
- After the 14-day period, pro-rata refunds may be available depending on services already provided; contact us to discuss.
- Cancellation requests should be submitted in writing (e.g. email or post).

Please include your booking reference, date of consultation, and reason for the refund request.
Processing Time
Where you exercise your statutory right to cancel, we will reimburse you without undue delay and in any event within 14 days of being informed of your cancellation, as required by law. We aim to process all approved refunds within 10 working days where possible. Refunds will be made to the original payment method unless you agree otherwise; you will not incur fees as a result.
Our Right to Cancel
In rare circumstances, we may need to cancel a scheduled consultation. If this occurs, we will offer you an alternative appointment or a full refund, at your choice.
